We reserve the right to modify or discontinue the Service (or any part thereof) without notice at any time.

5. Products, HVAC Equipment, and Quotations

Products or services may be available exclusively online with limited quantities and are subject to return or exchange strictly per our Return Policy.
We reserve the right to limit sales or quantities to any person, geographic region, or jurisdiction.
Website prices, estimates, or promotional figures do not constitute a final binding quotation unless confirmed in writing by Climax Air Conditioning Inc. Final pricing may vary based on on-site conditions, electrical requirements, ductwork, venting, gas piping, structural layouts, and local permitting requirements.

6. HVAC Installation, Service, and Payment Terms

Site Access & Responsibilities: Safe and clear access to mechanical rooms, electrical panels, attics, crawlspaces, rooftops, or designated areas must be provided by the customer.
Additional Work: Unforeseen structural modifications, drywall repair, painting, finish carpentry, or work required by other trades are not included unless specified in a signed agreement.
Title & Retention: We retain full legal title to all equipment, parts, and materials furnished until final payment is made in full. If unpaid, we reserve the right to remove equipment/materials and pursue legal remedies, including placing liens at the buyer’s expense.
Payment Terms & Late Fees: Payment is due in full upon completion of work unless a structured payment plan is signed. Unpaid balances accrue interest at the maximum legal rate (or 34.489% APR where lawful). A $50.00 fee plus bank charges applies to returned checks. All deposits are non-refundable.
Credit Card Processing: Credit card payments may be subject to automated transaction fees as specified in your agreement or invoice.

7. Manufacturer and Labour Warranties

Manufacturer Warranties: All materials, parts, and HVAC equipment are covered solely by the respective manufacturer’s warranty terms and registration requirements. Customers are responsible for completing required registrations.
Labour Warranties: Labour performed by Climax Air Conditioning Inc. is warranted strictly per your project agreement or invoice. Labour warranties become null and void if any unauthorized third party or technician services or alters the equipment.

8. Accuracy of Billing and Account Information

We reserve the right to refuse or cancel any order. You agree to provide current, complete, and accurate purchase and account information for all transactions made with us.

9. Third-Party Tools and Links

We may provide access to third-party tools or external links over which we neither monitor nor have control. Access is provided “as is” and “as available” without endorsement or warranties of any kind.

10. Personal Information

Your submission of personal information through the store and website is governed by our Privacy Policy.

11. Errors, Inaccuracies, and Omissions

We reserve the right to correct any typographical errors, inaccuracies, or omissions, and to change/update information or cancel orders if any information on the site is inaccurate at any time without prior notice.

If any provision of these Terms is determined to be unlawful or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

16. Termination

These Terms remain effective unless terminated by either you or us. You may terminate by ceasing use of our site. We may terminate access immediately if you fail to comply with any provision.
